1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you, either an individual or a legal entity ("you" or "User"), and Snippethub ("we", "us", or "our"). By downloading, installing, or using any products or services provided by Snippethub, including but not limited to the SnippetHub and associated services (collectively, the "Services"), or by clicking an "I Accept" button or checkbox associated with these Terms, you affirm that you understand, agree to, and accept all terms and conditions contained herein. If you do not agree to these Terms, do not use the Services. "You" also refers to the entity on whose behalf you are acting, if applicable.

Snippethub reserves the right to update or modify these Terms at any time at its sole discretion. Your continued use of the Services after such changes signifies your acceptance of the revised Terms. We encourage Users to review these Terms periodically. If you disagree with the Terms, your sole recourse is to discontinue using the Services and cancel any accounts you have created for the Services.

Violation of these Terms may lead to warning issuance, suspension, or termination of your access to the Services. Snippethub may enforce these actions without prior notice, though it reserves the right to issue notice at its discretion.

You acknowledge that Snippethub may modify or discontinue any part of the Services at any time without notice or liability to you. You confirm that you are legally eligible to enter into these Terms, are at least 18 years of age, and are not prohibited from receiving the Services under the laws of your jurisdiction.

2. Description of the Services

The Services provided by SnippetHub include, but are not limited to, AI-driven code suggestions, snippet management, and test generation within development environments. While we strive for accuracy and integrity in our Services, we do not assume responsibility for the content generated or suggested by the Services, including its integrity, accuracy, or reliability. The performance of the Services may be affected by various factors beyond our control, and we are not liable for such disruptions.

Our Services may offer tailored suggestions based on your unique codebase ("Tailored Services"). These Tailored Services require your explicit request and granting of access to your code. The code you provide will be used solely to enhance the Services for your use. We respect your intellectual property; thus, the code provided will not be stored or used by SnippetHub beyond the provision of the Tailored Services.

You bear ultimate responsibility for the use and incorporation of any suggested code into your software. It's crucial to review the respective license terms of any suggested code. While we use Free and Open Source Software ("FOSS") in our Services, we make no warranties beyond our compliance with the respective license terms of the FOSS.

3. Access to the Services

It is your responsibility to ensure your device meets all necessary specifications to access and use the Services. SnippetHub does not provide the equipment to access the Services, and you are responsible for all fees incurred from third parties in using the Services (e.g., internet service provider fees).

4. Account Information

You may be required to sign in using an authentication provider or create an account ("Account") to access the Services. Keep your Account and login information secure and do not share it. You are responsible for all activity under your Account. Notify SnippetHub immediately of any unauthorized use of your Account. By providing personal information during the account creation or update process, you consent to the handling of your information as per the SnippetHub Privacy Policy, which is an integral part of these Terms.

5. Privacy and Data Protection

The privacy and security of your personal information are paramount to us. Any personal information you provide when setting up or updating your Account, or during your use of the Services, will be treated in accordance with SnippetHub's Privacy Policy, an integral part of these Terms. You warrant that you have the authority to provide such information and that it is accurate and up-to-date.

6. User License

Subject to your adherence to these Terms, SnippetHub grants you a non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. This license is contingent on your compliance with these Terms. If at any point you do not agree to these Terms, or if you violate them, your license to use the Services will terminate immediately. You must refrain from using the Services if they are deemed illegal in your jurisdiction.

7. Payment and Subscription Terms

SnippetHub offers various subscription plans for the Services, some of which may be free and others may require payment. Your access to and use of the Services are subject to timely payment of applicable fees. SnippetHub reserves the right to modify or discontinue features, services, or subscription fees at any time. You are responsible for reviewing the SnippetHub website for updates on fees and services. All fees are exclusive of taxes and payable in United States dollars. The fees are based on the Services purchased and not on actual usage.

8. Refund and Cancellation Policy

If you encounter issues with the Services or they do not perform as described, you may request a refund from SnippetHub, which may be granted at our sole discretion. If you decide to cancel your subscription, please contact us within the first 30 days of service for a full refund. No refunds will be provided for cancellations after this period.

9. Account Suspension and Termination

SnippetHub reserves the right to terminate or suspend your Account and access to the Services for any reason, including violations of these Terms or illegal or improper use of your Account. You may lose your username and any associated data as a result of Account termination. You are responsible for securing backups of your data. SnippetHub is not liable for any loss or damage resulting from the loss of your Account or data.

10. User Conduct

By using the Services, you agree to adhere to these Terms and all applicable laws. You are prohibited from using the Services to engage in any illegal, fraudulent, or harmful activities or to infringe on the rights of SnippetHub or any third party. Any violation of these Terms may result in the termination of your Account and access to the Services.

11. Intellectual Property

SnippetHub and its licensors own all rights, titles, and interests in the Services and all related materials. You agree not to modify, distribute, create derivative works from, or use the Services or any related materials in any way not expressly authorized by these Terms. Any unauthorized use may result in termination of your Account and legal action.

12. Disclaimer of Warranties and Limitation of Liability

SnippetHub provides the Services "as is" and disclaims all warranties, express or implied. We do not guarantee the accuracy, reliability, or completeness of the Services or any related content. SnippetHub is not liable for any damages resulting from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

13. Indemnification

You agree to indemnify and hold harmless SnippetHub and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

14. Third-Party Interactions

During your use of the Services, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of third parties. Any such activity, and any terms, conditions, warranties, or representations associated with such activity, is solely between you and the applicable third-party. SnippetHub does not endorse any third-party materials or services and shall have no liability, obligation, or responsibility for any such correspondence, purchase, or promotion between you and any such third party.

15. Amendments to Terms

SnippetHub reserves the right to amend these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to check the SnippetHub website regularly for changes to these Terms.

16. Communication and Notices

Communications from SnippetHub to you may be made via email or through the Services. Notices regarding changes to these Terms or other matters will be made available through the Services or via email. You agree that all agreements, notices, disclosures, and other communications that SnippetHub provides electronically meet any legal requirement that such communications be in writing.

17. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which SnippetHub is established, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding between you and SnippetHub will be brought exclusively in the courts of that jurisdiction.
